Kyron Horman case: The pickup

In a Q&A session Friday night, Kaine Horman, father of missing 7-year old Kyron, was asked the following questions:

Kaine, why did you and Terri switch cars the day Kyron disappeared? Did you typically drive the white truck, and Terri the red mustang? Did she request to have the truck that day?

Kaine’s answer was…

I typically drive the truck and Terri drives the car. She wanted to use the truck to bring Kyron’s science fair project home, easier done with the truck than the car, although she did not stay for the duration of the science fair – per her statements that the media has reported.

It has already been discussed extensively that the red mustang was Terri’s car and that, for some reason, on June 4th she drove the white F250 Ford truck instead.  It has also been discussed that it appeared the science fair project was already set up on Friday morning when Skyline Elementary opened its doors early to students and family to allow them to tour the science fair projects.  In Kaine’s response above please note that he did not state she used the pickup that day to TAKE the project to school, but to bring it home.

Now, this begs the question that if Terri and Kaine discussed her using the pickup for the explicitly stated reason of picking up the science fair project, then why did she do things in a way that made no sense, and showed she did not start the day intending to pickup the project?

The first curious thing to point out in this discussion is that Kaine states “…although she did not stay for the duration of the science fair – per her statements that the media has reported.”  This statement reads as though Kaine has received this information as different than he believed the day would go.  Had Terri led Kaine to believe she was going to the science fair and staying until it was over at which time she would take the project with her?  This would actually make the most sense, since in the photos we have seen of Kyron and his project at the school, the projects appeared to be set up in classrooms on students’ desks.  In order to continue the regular school day classes after the fair was over, these projects would have to be moved off the classroom desks in order to allow the children access during their classes.

But Terri didn’t do that.  She drove to the school with the pickup and then left the school without the project – and didn’t even stay until the fair was over.  Now, you might say, she intended to pick the project up after school.  There three things that don’t make sense if that was her intention:

1.  It has been reported (but remains unconfirmed as far as I know) that Terri sent an email to Ms. Porter in the afternoon asking her when the science fair projects could be picked up.  This email has never made sense to me.  First, Terri was just there that morning.  We know that teachers were present at the school while Terri was at the school.  Why did Terri, if she knew she couldn’t stay until the end of the fair, not ask a teacher at what point the projects could be picked up?  Second, why did the question need to be asked at all?  An email wasn’t needed…period.  Would it not make sense to plan to pick Kyron AND the project up at the end of the school day instead of having him ride home on the bus, load him up, and then return to the school to get the project?

2.  Kaine only worked a half day at the office.  Why did Terri feel she needed to swap vehicles to get the project home if she knew she wasn’t going to pick the project up before the end of the school day?  Kaine was going to be home by that time and the pickup would be back at the residence.  The only logical and benign reason for swapping vehicles in the morning would be if Terri didn’t know Kaine planned to work at home that afternoon.  Did Kaine decide after he got to work that he would work the last half of the day at home?  I actually believe the answer is no.  And the reason I feel this way is because of the plans he made with Kyron to go get ice cream after Kyron’s school day was over.  Taking into account that Kyron was going to be leaving later in the evening to travel with Desiree back to Medford, it makes no sense that Kaine would be discussing going for ice cream at 5:30 or 6 o’clock at night.  It makes much more sense that Kaine intended, when he made the statement to Kyron that morning, to be at home when Kyron arrived there from school so they could go for ice cream shortly afterward and earlier in the day.  In fact, I would venture to guess that when Kaine got home at 2 p.m. he most likely assumed that Terri had already brought the project home.  And most likely, he didn’t even clarify whether she had or not, just assuming she had because that was the entire reason for her taking the pickup…or so Kaine believed.

3.  And then lastly, why didn’t Terri plan to the do the logical thing and pick the project up at the end of the school day?  The email to Ms. Porter (if it actually was sent) shows that this was not her intention, and it boggles my mind that it wouldn’t be.

Since we know that the science fair project was not brought home that day (prior to the end of school) the question becomes…why did Terri want the pickup and could this give insight into what happened to Kyron?  There are a number of reasons I can think of for needing a pickup versus a small two-door car.

1.  Large tools – shovel, container???, etc.  Did Terri need the pickup to transport things she would need to dispose of Kyron?  Did she need it to transport something in the bed that would not look suspicious in the bed of a truck, but would if seen in a car?  I can think of several things that would fall into this category.

2.  Off road access – did Terri leave that morning knowing that she was going to be driving to a remote location the Mustang wasn’t suited to reach?  A rough, rocky mountainous dirt road?  A swampy, muddy shoreline area?  Keep in mind it had rained almost every day for a week and rained on June 4th.  The ground would have been moist to downright muddy depending on what type of location she planned to access.

3.  Easy access to cab interior – unlike the Mustang, which is a cramped two-door car, the F250 Ford truck the Horman’s own is a crew cab with four doors, did Terri plan ahead to make sure access and/or retrieval from the cab would be as simple as possible?  If there is validity to “Chas’s” account of seeing Terri Horman pull out on Hwy 30 headed south, I note that he saw a red-headed woman driving the truck, but he did not see any children.  If the children (assuming Kiara was also with them) were in the backseat, he most likely would not have seen them due to the heavy tinting on the back door windows of the truck.

I believe Terri led Kaine to think that she was going to the science fair with Kyron and when the fair was over she was going to bring his project home – therefore she needed the truck.  And I am beginning to believe that we are seeing enough information to start believing the yet unconfirmed account that Ms. Porter claims Terri told her, that morning, “in a crowded auditorium”, that Kyron had a doctor’s appointment and they were going to have to leave before the fair was over.  I am also beginning to believe that Terri and Kyron (and Kiara??? still unknown) left the school quickly.

I offer the following scenario in how Kyron could have been taken from the school, by Terri, without being seen together.  On the way to the science fair Terri stated, for the first time, to Kyron that he had a doctor’s appointment that morning and that they weren’t going to be able to stay at the fair/school very long.  At approximately 8:45 (prior to 9:00 a.m. when the classes began touring the fair) Terri told Kyron to go on out to the truck and she was going to take care of telling Ms. Porter that he was going to the doctor.  Kyron went on out to the pickup and got in the backseat where he would normally ride.  If Terri had not already told Ms. Porter of the doctor’s appointment, she did so at this time.  But irrespective of what Terri did next, she intentionally lingered in the school long enough to ensure that if she was seen leaving, she was seen leaving alone.

Now, the only hiccup to this scenario is that Mr. Matt Shelby has stated that two teachers believe they saw Terri and Kyron leaving the school that morning together.  (CORRECTION AS POINTED OUT BY MY READERS:  Actually Mr. Shelby made a nonstatement (which seems to be a habit for him).  He stated two teachers saw Terri and Kyron at the school that morning and believe they left together.  Make of that what you want…that’s exactly what I think Mr. Shelby intended us to do.)  If this is true, then the scenario would be that after spending a brief time at the fair (and getting the requisite pictures), Terri found Ms. Porter in the auditorium/gym, told her of the doctor’s appointment, and then she and Kyron quickly left.

Whatever the true events are on how Terri handled exiting the school that morning with Kyron, the facts are beginning to show that she left the Horman residence that morning in a vehicle that would serve her plans for the day.  And those plans do not appear to have included bringing Kyron’s science project home.

Eric Preimesberger case: A continuing look into this mysterious case

This is to allow the discussion to continue on the mysterious disappearance of Eric Dee Preimesberger in Reno, Nevada some where around the 20th of April, 2010.  At this time Eric’s wife, Kristi, (last known person to have seen him) is still missing.  Her previous accounts to family, friends and law enforcement on the events surrounding Eric’s disappearance are suspect, inconsistent, and downright hinky.  Kristi was last seen (as far as we know) on June 16th after spending a couple of weeks with Eric’s stepsisters in Vancouver, Wa.  She left their home with two small children, Ivy Preimesberger – age 6, and Damion Preimesberger – age 20+ months.  Based on the limited amount of information and past history the children are considered endangered.

In addition to Kristi Morgan Preimesberger being missing, with her and Eric’s two small children, Tim Morgan, Kristi’s brother is now missing.  Tim had traveled to Reno, NV sometime either before or right after Eric went missing.  He is reported to have helped Kristi load up all belongings at the rent home she and Eric had shared in Reno, and accompany Kristi and the children back to his home in Eugene, Oregon.  They stayed there until they left to spend time in Vancouver with Eric’s stepsisters.

Personal message to readers

I have to apologize for the amount of time I have been away from the blog.  In addition to the issues and activities surrounding my daughter’s problematic pregnancy I have been dealing with the end-of-life issues that come with two ailing, elderly parents.  It has been time-consuming, emotionally draining and devastating to the heart – but at the same time a true labor of love.  We are nearing a point where very critical (and heartbreaking) decisions will have to be made.

My daughter

As those following Just for Chat know, my daughter is expecting my first granddaughter.  She has had a difficult pregnancy.  She was originally pregnant with twins and lost one.  She has since been in out of the ER and we lately finally learned that the problem is an “extremely shallow cervix”, which means she won’t be in labor long.  In fact, the OB/GYN has stated if she has more than one contraction in an hour, we are to be in the ER because she may deliver.  At one point we feared she was going sepsis, or into toxemia.  She has gotten past the really bumpy part of the road and we are nearing 32 weeks.  We feel if we can make 32 weeks then the chances of a uncomplicated birth with little risk of long-term health problems for “Riley Marie” will be a high probability.

My father

My father started showing signs of Alzheimers probably before we detected them.  For some time dad’s far too often repeated stories had become longer and longer because he had begun to recount the stories slower and slower.  But the details (as far back as him being a small boy – and he’s 87 years old now) were always crisp.  But it was like over night that the light switched some 4 or 5 years ago and all of a sudden the words went away.  I remember the first day I got hit between the eyes with this.  He dropped by for something and he started telling me a story about a sunflower that had grown underneath my mother’s bird feeder (where she had sunflower seeds among other seeds to feed the bird).  The whole story was about this SUNFLOWER.  And then he got to the part where he needed to tell me about the SUNFLOWER growing under the birdfeeder.  The sunflower was the punch line, the climax, the finale of the story… and the word was gone.  Not even the word “flower” was there, or weed, or plant…nothing.  The whole main subject of the story was gone.  He just stopped, struggled for several minutes, and started crying.  I finally figured it out and said “sunflower?”  And he nodded his head yes and got his truck and went home.

Dad was diagnosed some time later with dimentia/Alzheimers.  He was started on medicine to try to slow the Alzheimers.  He is now in the advanced stages.

My mother

My mother was a stay at home wife and mother her entire life.  Dad and mom got married when he was 19 and she was 15 (they both lied about their ages on their marriage licenses).  They have been married for 67 years.  They are not two different people…they truly are one person.  My mom went from being raised by her father to be raising by my father.  They had five children, lived a good, hard-working modest blue collar life, and dedicated their lives to God and their family.  My mom does not know life without her protector and provider.

Neither my father or mother finished high school.  They were raised during the dust bowl days and the Great Depression.  Dad stopped working when he was in 11th grade so that he could help provide for his parents’ family.  Mom quit school in 10th grade when she married my father.  Mom started showing signs of possible Parkinson’s in 1995.  It started with an ever so slight head shaking.  She now is showing signs of severe memory loss and possibly perceiving events differently than they actually occurred.  In addition, she has been battling some pretty severe depression in the past few years because she is my father’s primary caregiver.  She has had to “grow up” (which she never had to do before) and has become a very strong woman who not only cares for herself, but for her protector who is now closing in on being the equivalent of an infant.

The situation

As stated before my father is now in the advanced stages of Alzheimers.  He is hallucinating.  He is imagining things.  He is becoming increasingly paranoid.  And he varies from noncommunicative to talking nonsense (very very slowly).  He is (or has, depending on how much I allow myself to admit denial) losing touch with reality.  Events just in the past couple of weeks have brought home that dad is really no longer in the reality the rest of us operate in.  I THINK my mother feels she can no longer care for him (coupled with her mental state is degrading from the dementia/Parkinsons she is dealing with and the constant stress of her husband no longer being there with her).  But, she promised my father she would never put him in a nursing home, and she is committed to that promise.

I have now had to have a talk with my mother to ensure her that she can confidentially call me and let me know when she can’t take anymore.  At that time I will be the one that calls my siblings and lets them know I have determined that dad must go to a nursing home for his own good and that of my mother’s.  (I live 6 blocks from them and am the person they rely on for assistance – in all respects.)

Tonight was the worst night so far.  Things have been very bad for several weeks.  Not only because Dad was showing increasing signs of either imagining, hallucinating or both (speaking of people being in the house who were not there), but because of my mother’s failing mind and the immense stress (which makes her mental state degrade even faster) of Dad’s condition.  Tonight, while I was over there visiting with them, my father all of a sudden says, “I’ve got a question.”

I responded, “Yes?”

He waves his hand at me and my mother and says, “You two.  You two.  Who do you two work for?”

It took me aback so bad I blurted out “the government”.  He nodded his head yes and got a look on his face that said, “I knew it.”  I said, “NO!  We don’t work for the government.  You know who I work for and mom has worked for you and your children for 67 years!”  The sad, sickening, irrational conversation went on for several minutes.

Long story short (like it’s not too late now) is that my dad is gone.  My mother is slipping and soon my siblings and I will be faced with a terrible task of putting my father in an assisted living facility or nursing home for Alzheimer’s patients in order to give my mother a better quality of life and some peace of mind.

It is taking a toll on me.

Because of these personal issues I have not been on much here lately.  I have tried desperately to keep up with Caylee’s, Kyron’s and Eric’s cases.  They are all very important to me.  But I will not guarantee that I will be able to stay on top of things in the coming days.  So I would recommend for up-to-date information on these cases you check other blogs and the major crime-solving discussion boards to keep abreast.

I am about to close the current Eric Preimesberger thread and start a new one, just to keep the discussion on this very troublesome (and exacerbating) case open.  I have started working on a preliminary timeline for Kyron’s case and will get it up as soon as I can.  But I might not have  significant presence in the coming days so that I can deal with the sad business of my parents.

I appreciate all the readers and commenters here.  You truly are an exceptional bunch of people.  If I have lapses of presence/moderation here at the board, I request you continue to treat each other with respect, and stick to the focus of each thread to keep an intelligent discussion moving foward.

Kyron Horman case: Interviews and searches continue

Searches are continuing to take place at locations previously searched by investigators in the Kyron Horman disappearance case.  Neighbors state searchers were back in the area of Skyline Elementary searching.  They returned to some private properties that they had already searched before.   In fact, some several times.  Residents in the area reported it appeared law enforcement was centering on properties where pick ups were owned.

In addition to new searches, investigators have begun to re-interview people who were at Skyline Elementary on June 4th, the day Kyron went missing.  Some of these people have already been interviewed multiple times.  Investigators have also asked local media if they would supply footage of any interviews they have done with “potential witnesses” on the case.  This curious move appears to be to try to further refine the timeline of events on June 4th.  MCSO spokesman Travis Gullberg stated the request does not indicate there is anything new in the investigation, only that they are attempting to ensure the accuracy of their information.   It appears that some people who have been interviewed by investigators went on to give different accounts in interviews to media.

Of particular interest in the articles covering the new activities on this case was the mention of a 7th grader from Skyline Elementary that I do not recall reading about previously.  Tyler Kessinger states he saw Kyron on the morning of June 4th at Skyline.  His statements appear, from news articles, to potentially have significance in locking down accounts and times at the school.  For instance, he states he saw Kyron in the gym “with friends”, but did not see Terri Horman with him at that time.  In fact, his statement reads, “I just saw him (Kyron) in the gym, and I saw the truck out in the parking lot.”  Now, the importance of this statement, if accurate, falls on what time he saw Kyron in the gym.  Law enforcement has requested he not publicly state what the time was.

Terri Horman states she left Kyron in the hall at 8:45 a.m. and left the school.  If Tyler saw Kyron in the gym past 8:45 a.m. – even more importantly after 9:00 a.m. – and noticed Terri’s white truck in the parking lot at this later time, it places Terri on the property at a later time in the morning than she has led investigators to believe and would show that she did not leave the property once she left Kyron in the hall.

But even if the time is not later in the morning, there could be further importance to Tyler’s account.  Ms. Porter, Kyron’s second grade teacher, is reported to have stated (this is unconfirmed to this date) that Terri told her that Kyron had a doctor’s appointment that day.  This is actually the only reason that has been given about why Kyron’s absence at 10:00 a.m., when roll call was taken after the science fair tour, did not alarm Ms. Porter.  Ms. Porter’s account states that Terri told her this in a crowded auditorium.

Now, Terri, through her friend Jaymie Finster, has rebutted Ms. Porter’s reported statement about the doctor’s appointment by stating she did not tell Ms. Porter about the doctor’s appointment on Friday morning, but instead on Thursday.  And Terri further states the doctor’s appointment was not on June 4th, but for the following Friday, June 11th.  Terri has also stated (all via Jaymie) that she also gave Ms. Porter paper work that needed to be filled out in connection with this doctor’s appointment.  As I have stated all along, this is a concrete statement that either can be confirmed or denied by the actual (if any) doctor’s appointment and required paperwork.  Either there was an appointment, or there wasn’t.  And either there was required paperwork for that appointment, or there wasn’t.

This curious issue remains unanswered even though it has been submitted in Q&A sessions to the family.  Kaine responded with a cryptic answer that they had heard of the appointment but had been unable to confirm when it was scheduled.  A bit of a nonstatement, if you will.

Could Tyler’s account of Kyron in the gym be verification of the reported statement by Ms. Porter?  Up until Tyler’s statements to KATU, there has been no confirmed placement of Kyron in a gym or auditorium.  (Keeping straight that in most small schools the gym usually doubles as the auditorium and some times triples as the cafeteria.)  Could Tyler hold more answers to these questions that have confused the timeline?

Caylee Anthony case: A hearing on contrivance

Today’s hearing in the Caylee Marie Anthony murder trial is all about contrivance.  Well, it’s about 911 calls, but both sides will argue their versions of what was contrived.  Ever since the Anthony wagon train circled Casey Anthony – who has become everything to this family from beloved last female heir to the keys of the family shield of self-righteousness to their cash cow and some form of sneeze-induced code-talking shaman that blesses beads and has a direct line to “Daddy” – Cindy’s excuse for uttering the now famous line “I found my daughter’s car today and it smells like there’s been a dead body in the damn car” has been that she made it up for shock value to get the authorities to her house as quickly as possible.  In other words, she claims it was contrived.

Interestingly, that’s what the state will be arguing today as well….the statement was made based on a contrivance, but not by Cindy – by Casey.

Just which side’s contrivance wins the day remains to be seen until after the honorable Judge Perry rules on today’s hearing.  But my bet is that the State’s argument of Casey’s contrivance will win over the defense’s argument of Cindy’s contrivance.  And the reason will be the very evidence that will be admitted today in order to rule whether it will ultimately be admitted during the murder trial itself.

Contrivance #1 – the State’s argument:

The State of Florida will be arguing today that Cindy’s statements in the third 911 call are admissible and of importance to their case because they are based on the evolving story of Casey Anthony once Cindy found her at Anthony Lazzaro’s apartment.  Based on the evidence within the 911 calls themselves they believe it can be shown that Casey contrived the kidnapping story in between call #2 and call #3 made on July 15th.   Their argument will include that because Casey did first share the contrived story of “Zanny the Nanny kidnapping of Caylee a month before” just before the third call, the revelation of the contrivance to Cindy Anthony caused her to become so panicked over the thought of 2-year old Caylee Marie being abducted that when she got on the third phone call and made the “dead body” statement, she was in an excited or panicked state .  If they prove this position, under Florida Statute 90.803, the statement (in fact, the entire phone call, at least Cindy’s parts) becomes an “excited utterance” and therefore falls within the exception to the hearsay rule.  The referenced statute reads as follows:

90.803  Hearsay exceptions; availability of declarant immaterial.—The provision of s. 90.802 to the contrary notwithstanding, the following are not inadmissible as evidence, even though the declarant is available as a witness:

(1)  SPONTANEOUS STATEMENT.—A spontaneous statement describing or explaining an event or condition made while the declarant was perceiving the event or condition, or immediately thereafter, except when such statement is made under circumstances that indicate its lack of trustworthiness.

(2)  EXCITED UTTERANCE.—A statement or excited utterance relating to a startling event or condition made while the declarant was under the stress of excitement caused by the event or condition.

Contrivance #2 – the Defense’s argument:

The defense’s argument is based on Cindy’s repeated mantra that she “threw in” (i.e. contrived) the statement that the car smelled like a damned dead body in order to ensure law enforcement took the call as urgent and of a possible homicide in order to get them to come immediately to her home.  In other words, she is saying she didn’t mean it really smelled like a damned dead body, but she was willing to “stretch the truth” (in verbal acrobatics that the entire Anthony clan have perfected – well, sans Lee, he’s not too polished) to get them to her house.

The Evidence for today:

Today’s hearing will include at least the following:

  • Audios of 911 call #1, #2 and #3
  • Testimony from Cindy Anthony
  • Testimony from Lee Anthony

Now, the state has offered they don’t need all three 911 calls in the murder trial because they believe they can show the progression of Casey’s story and the effect it had on her mother, Cindy, with just two of the calls.  I don’t necessarily agree that they should have made this offering.  I believe the package of all three 911 calls brings home just how Casey spun the story that evening as Cindy, and Lee, increased the pressure on her to take them to Caylee.  I also believe the extreme difference in Cindy’s demeanor and apparent state of mind in each call shows how what was being said to her in the periods between each call was of a revelatory nature and had an immediate impact on her psyche.  I believe the audio of all three calls will have a similar effect on the jury.

Because…it’s not just the content of what Cindy says from Call #1 to Call #3…it’s how Cindy’s emotional state has changed and how she says those statements in Call #3 compared to the other two calls that brings home that Casey has just hit Cindy between the eyes with a story she had never heard before just prior to the last call.

The Content of the Calls:

Sticking to the mere contents of the calls, however, shows how the situation was fluid.  In the first 911 call it’s not just what Cindy states to the operator, but what she states to Casey while she is waiting to be transferred that is of importance.  First, Cindy’s demeanor is let’s get the job done.  She states to the operator that she is sitting outside the Pershing Orlando Police Department station (which is closed at the time) and she wants to bring her daughter in to be charged for stealing money and her car.  At this time Cindy does not mention that she hasn’t seen her granddaughter in a month, but merely mentions these potential charges of theft.  The operator, after trying to get clarification on jurisdiction, begins to transfer the call to Orange County Sheriff’s Department.  It is during this transfer time that Cindy states to Casey (which is picked up in the audio recording of the call):

Cindy:  (speaking to Casey Anthony) Because my next thing will be down to child (inaudible) and
we’ll have a court order to get her. If that’s what you want to play, then we’ll do it, and you’ll
never
Casey Anthony: Well, that’s not the way I want to (inaudible)
Cindy: Well, then you have –
Casey: Give me one more day.
Cindy: No, I’m not giving you another day. I’ve given you a month.

Even though Cindy has not mentioned that she is trying to get her daughter to tell her where Caylee is, she clearly indicates in these side comments to Casey that is her intent and that she will take legal action in a family court to get it done.  In other words, Cindy’s statements to Casey show that the statements made to the operator (i.e. I’m wanting to have her arrested for theft) are contrived.  But these side comments also reveal something else at this time…Cindy is not appearing to be in an emotionally distraught state, but an aggravated state due to Casey not telling her where Caylee is.  Her apparent plan is to get Casey before law enforcement on the grounds of having her arrested for theft and then use the situation she has gotten Casey into to pressure Casey into telling her where she can pick up Caylee.

In the second 911 call, made after Cindy, Casey and Lee arrive at the Anthony home, Cindy is still in her “let’s get down to business” state.  She’s still aggravated but now not only at Casey, who still hasn’t told her where Caylee is, but at the authorities because she’s having to make a second 911 call from the residence per their instructions.  This is most manifested by Cindy having on her “Cindy Anthony rude pants” during the phone call.  She is terse, condescending, and rude to the operator who is attempting to get all required information to process the 911 call and determine the level of importance she needs to place on the response.  This is rather important because if Cindy wanted to get someone out there immediately, this was the opportunity to do so and it wasn’t going to be by being an asswipe to the operator.  But that, indeed, is exactly what she is.

It is, in fact, the disdain in Cindy’s voice when responding to the operator in this call that I believe makes it very important to the progression of all three 911 calls, and why I do not agree that it should be excluded, nor the first call for that matter.  This is the first phone call in which Cindy states to the operator that she has a “3-year old” that has “been missing for a month”.  Now, it should be pointed out that Cindy throws this in after her repeated statement from the first 911 call that her primary contrived reason for calling is to have Casey arrested for theft.  She goes on to repeat that Casey has stolen her car and her money.  In the middle of this is an inserted “side note” of a missing 3-year old (which, by the way, really bugs me because Caylee wasn’t 3 yet.)

Combining the first two statements of what is being claimed by Cindy from the second call shows this very graphically:

Uhm, I have someone here that I need to uhm, be arrested in my home…And I have a possible missing child. I have a three year old that’s been missing for a month.

Oh…and by the way, I have a 3 year old missing for a month.  To this nonchalant delivery of this new piece of information the operator responds with…

A three year old?  Have you reported that?

And this is where Cindy’s disdain comes into play to show the progression of her state of mind from these first two calls to the third one.  Her response is “I’m trying to do that now ma’am.”  Well, what rudeness, Val?  She called her ma’am.  Uh huh…I’ve got a character in my life that in the first few meetings I had with him (in a professional setting) called me “ma’am” as well.  My boss was sitting in those meetings.  To this date my boss laughs because this jerk’s delivery of “ma’am” was so condescending and disrespectful that my boss, to this day, can’t believe I didn’t come unwound like a spring in a broken clock.  (The relationship with this man has since matured.  I’ve earned his respect, and I haven’t been called “ma’am” in quite some time.)  This is the same condescending delivery Cindy uses in this response.  She is clearly more aggravated than she is panicked.

And then comes the “bombshell” call.  The call the defense will be arguing vehemently today should be dismissed for (Lord only knows how many different reasons Baez will bobble-head his way through) – hearsay, inflammatory, she made it up…we just don’t like it!  The third 911 call.  The “let’s get down to business Cindy” is gone.  Cindy is clearly emotionally distraught.  She is panicked.  She is in a heightened emotional state.  The entire call is centered on Caylee being not just missing, BUT KIDNAPPED. And here are the statements that prove that this change in emotional state is because of an immediate reaction to information just passed to her by Casey:

“…And my daughter finally admitted that the babysitter stole her. I need to find her.  That the babysitter took her a month ago. The daugh…my daughter’s been looking for her. I told you my daughter was missing for a month. I just found her today but I can’t find my granddaughter. And she just admitted to me that she’s been trying to find her herself. There’s something wrong. I found my daughter’s car today and it smells like there’s been a dead body in the damn car.

Cindy has clearly and admittedly just been told that Caylee was kidnapped a month before and that Casey has been trying to find her.  And here is where Cindy’s claim of “contriving” the added information of the “dead body” statement in order to get the cops to her house faster falls through.  Anybody in their right mind would think reporting the kidnapping of a 3 year old child who has been missing for a month as adequate enough to get a top priority rating on their 911 call.  A car smelling like a dead body does not make this more urgent because a “possible missing dead body” does not require the urgency of a “missing and kidnapped child” needing rescue from a dangerous situation.

Lee will testify today.  He will be asked about his statements to OCSO in his July 29, 2008 interview.  They went like this…

LA: Oh, well she kind of went up. And I can tell you she. She, her eyes were watered. She had been crying. Now it’s not balling mind you, she had been crying. But when my mother came in and started, “What’s going on,” and when my sister said, “I don’t know where, where Caylee is,” again her voice escalates when my mom gets in the room almost combatively. Uhm, my sister, when she explains that to my mom, “I don’t know where Caylee is,” and then my mother immediately goes, “Who took her? Who took her?” And, and, and then Casey goes, “Uhm, the nanny did. She was kidnapped Mom.” And then that’s when my mother kind of hit her fist on the bed and said, “We could have found her a month ago.  Why did you wait?” And at that point my sister is done crying. She’s, now they’re fighting about you know, this stuff in the past instead of trying to focus on the information that we need to get.

So at this point in time I was, I ran out to the kitchen, hoping to grab a pad and paper, you know, a pad and a pen so I could start asking my sister who, where, what, why, so I can already have this info kind of ready to go, or I could even start myself looking into it. And by the time I got back with the sheet of paper my mother had already called 911 again. That was that, you know, that…other 911 ticket was released. Called it again to say, you know, she just admitted that you know she’s kidnapped. We have to find her, you know, whatever. When my mother is in the other room on that call that’s when I was sitting there with my sister with this pad and paper and saying ok, so give me something, you know. And then the first thing that I asked her is, “Where have you been staying?” I don’t know why I asked her that question first. It was just the, it was the first thing that popped in my mind.

And that will be that.  State’s argument that Casey’s contrivance immediately before the last 911 call placed Cindy Anthony in a panicked state that she immediately acted and spoke within…the statement will be proven to be an excited utterance and the development of Casey’s contrivance will be allowed to be audibly presented to the jury, along with the fact that what was bearing on Cindy’s mind at the moment of that third 911 call was…

the connection between the just revealed kidnapping of her granddaughter and the fact that car smelled like a damned dead body.

Kyron Horman case: Court records filed show sex played role in murder-for-hire relationship

Kaine Horman has filed new family court documents requesting Terri Horman be held in contempt for not only showing the contents of the sealed restraining order to unauthorized persons, but allowing them to take photographs of that restraining order.  That unauthorized person was Michael Cook who has been in the forefront ever since the Kyron Horman case went public.  Michael Cook, high school friend of Kaine Horman, was the man who organized the first vigil for Kyron on June 7th.  He also quickly became spokesman for Terri Horman on the evening she was served the divorce petition and restraining order.

According to the papers filed by Kaine today, law enforcement has been reviewing Terri’s cell phone records and computer records as well as Michael Cooks’ cell phone records.  On the evening of June 28th, the day Terri was served, Michael was in the front yard of the Horman home, even though his “life-long friend” no longer lived there, asking the public not to jump to conclusions about Terri’s involvement in Kyron’s disappearance.  It appears he did more than that.  On that same date Terri showed him the restraining order and allowed him to photograph certain pages of it, including the portion that contains Kaine and Kiara’s current, undisclosed residence.  Of significant concern is the finding by law enforcement that Michael Cook used Google maps on his phone to pinpoint the exact location of Kaine’s current residence.

In support of the move for contempt against Terri the legal documents filed state that on June 30th Terri and Michael Cook began a sexual relationship.  This relationship included taking pictures of themselves in varying degrees of undress and while performing “graphic sexual activity”.  In addition, it appears Terri and Michael have been indulging in a bit of sexting.  In between the sexting sessions, Terri worked in that she missed both kids.  A particular revealing statement is made about the messages sent from Terri to Michael:

Law enforcement has informed Petitioner’s attorney that Respondent’s stated personal relationship concerns and sexual overtures to Mr. Cook resemble those made to the man Respondent previously attempted to hire to murder Petitioner.

It should be pointed out that this indicates that written communications, either in the form of text messages or emails, between Terri and the “landscaper” she tried to hire to kill Kaine are in law enforcement’s possession.

Another revelation in the documents comes with the next statement:

Further, law enforcement has informed Petitioner’s attorney that an identified clerk at a known local gym reported that on or about June 28, 2010, and prior to the service of the legal documents, Respondent came to that location looking to “abduct” her daughter, Kiara, from the gym daycare center while Petitioner worked out at the gym.  Respondent asked the clerk to contact her if Petitioner came to the gym with Kiara.

Kyron Horman case: Was Terri on Hwy 30 June 4th?

Maura has made a couple of lengthy comments here in which she goes over the rumors of Terri Horman’s cell phone pinging on Sauvie Island.  While these rumors remain unconfirmed at this time, I believe it is worth looking at Maura’s work and incorporating a potential eye witness account that places Terri in the same area on Hwy 30 just to the west of Sauvie Island.  First Maura’s statements:

Weeks ago, James Pitkin of the Willamette Week reported that his sources (five LEOs who were not directly involved in the case but who had obviously picked up rumors) told him that Terri’s cell phone pings indicated she MAY have been on Sauvie Island and that there were discrepancies in the account she had given of her activities on June 4. There are no cell towers on Sauvie Island, so if LE had reason to believe she may have been on the island per a cell ping, then she must have pinged a tower within range of some part of the island.

So I am guessing Terri was very vague about those errands she said she ran after leaving the school on June 4. Since LE has asked two specific local grocery stores for video footage, she must have said she went to a grocery store on June 4 but had no receipt. Maybe she was unable to identify the store she went to or maybe she gave the name of a specific store but video for June 4 showed she had not been to that store, so LE is checking other grocery stores in the area.

I wrote a comment a while ago about the cell towers in the area, and as I said, the Horman house and Skyline Elementary School are both located in a heavily wooded/forested area, and Terri would have driven south to one of the developed communities such as Oak Hills, Beaverton, Hillsboro, Hillsdale, or North Plains to run errands or buy groceries. Oregon Highway 26 runs through those communities, and there are a number of cell towers along Highway 26.

In fact, one of the two grocery stores mentioned in the article is directly on Highway 26 and the other is about 1/2 mile off Highway 26, so if she said she had driven south to buy groceries after leaving the school and if she had used her cell phone during that time, she would have pinged one of the cell towers along Highway 26.

The cell towers along Highway 26 are all located to the south of the Horman residence (southwest, south, and southeast of the house). There are no cell towers within range of the Horman residence directly to the east or west of the house. To the north, there is one cell tower at Scappoose High School, which is about 6-to-7 miles north of the Horman residence and about 8-9 miles north of the school. The Scappoose High School cell tower is located on Highway 30 near the northwest section of Sauvie Island.

Sauvie Island is about 15 miles long and 4 miles wide and is ringed by three waterways. The Multnomah Channel runs along the long western shore of the island. Immediately to the west of the Multnomah Channel is Oregon Highway 30. Immediately to the west of Oregon Highway 30 is a large forested area within which are the Horman residence and Kyron’s school. The Horman residence is only about three miles from the southwest section of the island, and the only access point onto the island for land vehicles is the Sauvie Island Bridge, which is only a four-mile drive from the Horman residence.

We all know LE has not been forthcoming with details, but connecting the dots of what has been reported (even if not confirmed) indicates that Terri probably claimed she drove south after leaving the school and ran errands (but can’t be specific about where she went and can’t provide receipts for any purchases she made). The fact that LE is requesting video from two grocery stores in the communities south of the residence supports the theory that she claimed to have driven south of the school to run errands on June 4.

However, ‘unnamed sources’ claim Terri’s cell phone pings contradict her account of what she did that day. Given the locations of FCC-approved cell towers in the area, it is likely she used her phone on June 4 after leaving the school but did not ping one of the towers south of the residence/school in the vicinity of those grocery stores but rather pinged the tower at Scappoose High School, indicating she had driven north after leaving the school rather than south.

If she had driven south to go grocery shopping, she could not have pinged the Scappoose High School tower because that tower would have been 10-15 miles away from the grocery stores in those communities and there are several cell towers along Highway 26 close to those grocery stores that she would have pinged.

If she did ping the Scappoose High School tower, it would mean she either drove north on Oregon Highway 30 toward Scappoose (the forest is to the left of the highway and the Multnomah Channel is to the right of the highway) OR it would mean she took the Sauvie Island Bridge to get onto the island itself and then drove north toward the Scappoose cell tower via an island road running along the western shore.

If you read the early reports of the searches, you’ll see that the search teams were asked to search both sides of Highway 30. Helicopters were seen flying low on multiple passes over the Multnomah Channel. Detectives made a door-to-door search of the residences on the island. Dive teams were sent into the Multnomah Channel. Helicopters made multiple passes over the island, and many ground teams (foot, K9, and horse-mounted) were sent to search Sauvie Island.

It’s my guess (and I want to be clear that this is conjecture based on unconfirmed information), LE knows Terri Horman drove north on the morning or early afternoon of June 4 because she pinged the Scappoose High School cell tower, but Terri claimed she had not driven north of the house on June 4 but instead had driven south to the school for the Science Fair and then driven even farther south to run errands (without being able to provide details or receipts) before returning home.

In a new KOIN Local 6 article a man wishing to go only by “Chas” told reporters he had called the tipline twice with a possible sighting of Terri Horman on Hwy 30 on June 4th.  He is concerned about whether his tips have been properly followed up on.  Let’s look at his account now:

Chas said he saw Terri Horman the day Kyron mysteriously vanished.

“I was on my way to work, driving down Highway 30,” said “Chas.”

It was Friday, June 4th, sometime between 9:15 and 9:45 in the morning. “Chas” was heading south on Highway 30, on his way to work when a white truck pulled out onto the road.

“It came out of one of these side streets, I am not exactly positive which one, but I am pretty much sure that it was north of Logie Trail road.”

Logie Trail Road is right across from Sauvie Island. One of the areas investigators have searched several times.

“I recognize that truck because I have a friend that has a similar truck and I thought it was him.”

But when “Chas” pulled up next to this truck, he saw that it wasn’t his friend, it was a red-haired woman, he didn’t recognize.

He later realized that “red-haired” woman was Terri Horman.

“I didn’t really think anything of it, obviously at that time there was no reason to.”

“Chas” said he’s been following Kyron’s disappearance since day 1, and when police released the flier asking the public to come forward with any information if they had seen Terri Horman or the white truck the day Kyron disappeared. That’s when “Chas” remembered back to June 4th and called the tip line.

“The next day, I called again, and gave a little bit more detailed information because in the back of my mind I was thinking maybe I didn’t give enough information.”

Approximately 3 miles south (less by the way the crow flies) is a side road onto Hwy 30 which is a junction between NW Old St. Helens Hwy, Rocky Point Rd and Hwy 30.

This is a side entrance onto Hwy 30 north of NW Logie Trail Rd just as Chas believes he remembers.  It also appears to be within the range of Scappoose High School cell tower.  In addition, Rocky Point Road is the upper bound of the routes for which MCSO requested surveillance video in the early days of the investigation.  Rocky Point Road is a “straight shot” (of course nothing is straight in those mountains) up NW Skyline Drive from the elementary school.  NW Skyline Drive also represents the western boundary of the upper portion of the routes for which MCSO requested surveillance video.
